Why Did the Justice Department Surge on Tax Fraud?

Because every dollar taken through a false return is a dollar taken from people who file and pay. On October 14, 2026, the National Fraud Enforcement Division, the IRS, and IRS Criminal Investigation announced the first National Tax Enforcement Surge. Between early September and that day, the Tax Section and 35 U.S. Attorneys' Offices took prosecutorial action against 76 defendants. The alleged and proven schemes intended more than $490 million in losses to the Treasury. Attorney General Todd Blanche said every dollar stolen through tax fraud is a dollar taken from the American people.

What the Surge Produced

Prosecutors returned 23 actions with new charges against 31 defendants, accounting for more than $350 million in intended losses. Another 39 actions, including trials, guilty pleas, and sentencings, covered 45 defendants and nearly $140 million more. Assistant Attorney General Colin M. McDonald said the Fraud Division is resolved to protect American taxpayers from criminal actors on every frontier of fraud, and that those who intentionally lie to steal the money of the American people should expect to answer in federal court.

The Noncitizen Cases on the List

Alarmingly, these tax fraud schemes also involve non-citizens. In Kansas, Kenyan national Ephantus Mwangi, a Missouri businessman, was sentenced to 51 months for willfully failing to pay over employment taxes from the credit-card processing companies he owned. During that period he spent more than $200,000 on loan payments for luxury vehicles, including a Hummer, a Cadillac Escalade, two Range Rovers, two Mercedes, and a Lexus. He pocketed his employees' Social Security and Medicare taxes to buy those vehicles. The Justice Department says he will be deported from the United States of America. In Georgia, three Mexican citizens were charged in a $74 million refund scheme that cashed more than 16,000 Treasury checks.

How the Schemes Were Built

These are criminal schemes built deliberately, run for years, designed to be hard to find, and paid for every single time by the Americans who file taxes honestly and pay what they owe. In Texas, four defendants were charged with promoting sham trusts that sheltered more than $1.5 billion in income and caused more than $200 million in tax loss. In North Carolina, a preparer was sentenced to 60 months for a COVID sick-leave credit scheme that produced $13.8 million in payments.

Strategic Implication of the First Surge

The surge is a template, not a one-week event. Thirty-five offices and IRS-CI produced 76 defendants and a half-billion loss figure in about six weeks. Blanche said there is no safe haven for fraudsters. The tax fraud cases that involve noncitizens add a removal consequence to the prison term. The tax fraud that runs through preparers and sham trusts is the volume business. The tax fraud that withholds an employee's payroll tax is the theft of a trust fund.
